Aetherium Realms – Terms of Use

Effective date: August 11, 2025

These Terms of Use (the “Terms”) govern your access to and use of the Aetherium Realms mobile game, websites, services, and any related content provided by Average Joe Ventures LLC (“Average Joe Ventures,” “we,” “us,” or “our”). By accessing or using Aetherium Realms (the “Game”), you agree to be bound by these Terms. If you do not agree, do not access or use the Game.

If you are accepting these Terms on behalf of an organization, you represent that you are authorized to bind that organization.

1. Eligibility & Accounts

Minimum age. You must be at least 13 years old to use the Game. If you are between 13 and 17 (or the age of majority in your jurisdiction), you may use the Game only with the consent of a parent or legal guardian, who agrees to these Terms.

Account registration. You may need an account to access certain features (including multiplayer). You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

One person, one account. You may not share, sell, rent, or transfer accounts. Account sale or transfer is strictly prohibited.

2. Platforms & Third‑Party Terms

App stores. The Game is available on Android and iOS. Your download and purchases are also governed by the terms of the applicable store (e.g., Google Play Terms of Service; Apple Media Services Terms and the Apple Standard EULA if applicable). Those third‑party terms are in addition to, not in lieu of, these Terms.

Device requirements. You need compatible hardware, software, and Internet access, which may require updates from time to time.

3. Virtual Items, Virtual Currency & In‑App Purchases

Virtual items. The Game may offer virtual currency (e.g., Gold), card packs, avatars, and other virtual items (collectively, “Virtual Items”). Virtual Items have no real‑world monetary value, are non‑redeemable for cash or anything of value outside the Game, and are a limited, revocable license to use features within the Game.

Acquisition. You may obtain Virtual Items through gameplay or via in‑app purchases processed by the platform provider (Apple or Google). Pricing and availability may change at any time.

No cash‑out; no transfers. Virtual Items and accounts may not be sold, traded, transferred, gifted, or exchanged for real money or items of value. Any such transactions are void and may result in suspension or termination.

Refunds. Purchases are final and non‑refundable except where required by applicable law or by the applicable app store’s policies. Refund requests must be directed to the platform provider that processed your payment.

Taxes & fees. You are responsible for any taxes or charges arising from your purchases.

4. Gameplay Changes, Balance, and Availability

Card stats & availability. We may modify, rebalance, disable, or remove cards, abilities, items, features, or content at any time to maintain fair play, address bugs, or for other reasons. This may affect gameplay, collections, deck composition, and perceived value of Virtual Items.

Service changes. We may update, suspend, or discontinue parts or all of the Game at any time, with or without notice. We will strive to avoid material disruption but are not obligated to maintain any particular feature or content.

Progress & data. We may implement updates or resets when necessary (e.g., for testing, maintenance, or to address exploits). We are not liable for loss of progress, rankings, or Virtual Items due to such actions, except as required by law.

5. Multiplayer, Fair Play & Community Conduct

Fair play. You agree not to cheat, exploit bugs, use unauthorized automation (bots), hacks, mods, or third‑party tools that interfere with gameplay, servers, or other players’ experience.

Conduct. Do not harass, threaten, or abuse others; do not post or transmit illegal, infringing, hateful, or otherwise objectionable content. Usernames, clan names, and in‑game chat must abide by these standards.

Enforcement. We may monitor and moderate multiplayer features. We may warn, restrict, suspend, or ban accounts for violations of these Terms, suspected fraud, or harm to the community.

Appeals. If your account is restricted or banned, you may contact support for a review. We may refuse to reinstate accounts in our reasonable discretion.

6. Slot Machine Mini‑Game (No Real‑Money Gambling)

Entertainment only. The slot machine mini‑game is for entertainment purposes only and does not use or award real‑world currency.

No cash value. Any rewards are Virtual Items or in‑game resources (e.g., Gold). Gold cannot be converted to real money or any item of monetary value.

Odds & disclosures. Where required by law, we may disclose reward probabilities or other information. We may adjust rewards, odds, and mechanics at any time to support fair play and balance.

7. Intellectual Property & License

Our rights. The Game and all content therein (including cards, artwork, code, music, logos, and trademarks) are owned by Average Joe Ventures or its licensors and are protected by intellectual property laws.

Your limited license. Subject to your compliance with these Terms, we grant you a personal, non‑exclusive, non‑transferable, revocable license to access and use the Game for your personal, non‑commercial entertainment.

Restrictions. You may not copy, modify, distribute, publicly display, reverse engineer, or create derivative works from the Game except as permitted by law or by express written permission from us.

8. User Content & Feedback

User content. If you submit or share content (e.g., usernames, chat, feedback), you grant Average Joe Ventures a worldwide, non‑exclusive, royalty‑free, sublicensable license to use, reproduce, modify, adapt, publish, and display that content for operating and improving the Game.

Moderation. We may remove or restrict access to user content that violates these Terms or applicable law.

9. Termination

By you. You may stop using the Game at any time and request account deletion per our Privacy Policy.

By us. We may suspend or terminate your access for any violation of these Terms, suspected misconduct, or to protect the Game or its community. Upon termination, your license ends and you may lose access to your account and Virtual Items.

10. Disclaimers; Limitation of Liability

AS IS. THE GAME AND VIRTUAL ITEMS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

No guarantee. We do not warrant that the Game will be uninterrupted, secure, or error‑free, or that defects will be corrected.

Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERAGE JOE VENTURES AND ITS AFFILIATES, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12‑MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID TO US (IF ANY) FOR THE GAME OR VIRTUAL ITEMS DURING THAT PERIOD.

Jurisdictional limits. Some jurisdictions do not allow certain disclaimers or limitations; in those cases, the above may not fully apply to you.

11. Indemnification

You agree to indemnify and hold harmless Average Joe Ventures, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Game, your user content, or your violation of these Terms or applicable law.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflicts‑of‑law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Angelina, Texas for any dispute arising out of or relating to these Terms or the Game, and you waive any objection to inconvenient forum. If you are a consumer in a jurisdiction that requires local consumer protections or venue, these provisions apply only to the extent permitted by law.

13. Updates to the Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., in‑app notice or by updating the “Effective date” above). Your continued use of the Game after changes become effective constitutes acceptance of the revised Terms.

14. Privacy

Our Privacy Policy explains how we collect, use, and share information when you use the Game. Please review it carefully. By using the Game, you consent to our data practices described there.

16. Additional Platform Notices

Apple (iOS) users. To the extent required by Apple, you acknowledge that Apple is not responsible for providing any maintenance or support for the Game; that to the maximum extent permitted by law, Apple has no warranty obligation with respect to the Game; and that Apple and its subsidiaries are third‑party beneficiaries of these Terms with respect to your use of the Game on iOS.

Google (Android) users. Your use of the Game on Android may also be subject to Google Play’s policies and terms.

17. Prohibited Uses (Summary)

Without limiting anything above, you agree not to:

Sell, rent, gift, or transfer accounts or Virtual Items; engage in real‑money trading (RMT);

Use cheats, bots, exploits, or unauthorized third‑party tools;

Harass, threaten, or abuse other players; post illegal or infringing content;

Attempt to gain unauthorized access to the Game, servers, or other players’ accounts;

Interfere with or disrupt the Game or its networks; or

Use the Game in violation of any applicable law or regulation.

18. Subscriptions (Auto‑Renewing)

Overview. We may offer auto‑renewing subscriptions that provide access to certain features, content, or perks (collectively, “Subscriptions”). Subscription terms (e.g., monthly or annual) and included benefits will be presented at purchase.

Billing & Renewal. Payment is charged to your Apple ID or Google Play account at purchase confirmation. Subscriptions auto‑renew unless canceled at least 24 hours before the current period ends. Your account may be charged for renewal within 24 hours prior to the end of the current period at the then‑current price.

Manage & Cancel. You can manage or cancel a Subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; access continues until then. We do not provide refunds or credits for partial periods, except where required by law or by the platform provider’s policies.

Trials & Intro Offers. If offered, free trials or introductory pricing convert to a paid Subscription at the end of the promotional period unless canceled beforehand. Any unused portion of a free trial is forfeited when you purchase a Subscription, where applicable.

Price Changes. We may change Subscription pricing or terms. Where required, we will provide notice and obtain your consent; otherwise, you may cancel before the change takes effect.

Restrictions. Subscriptions are personal, non‑transferable, and have no cash value. We may suspend or terminate a Subscription for violation of these Terms.

19. Promotions, Giveaways, Contests & Tournaments

General. From time to time we may run promotions, giveaways, sweepstakes, contests, events, or tournaments (collectively, “Promotions”). Additional Official Rules or terms may apply. If there is a conflict, the Official Rules govern that Promotion.

Eligibility & Compliance. Promotions may be subject to age, region, and other eligibility requirements and are void where prohibited. Employees, contractors, and agents of Average Joe Ventures and its affiliates may be ineligible. You must have an account in good standing.

No Purchase Necessary (where required). For sweepstakes or similar chance‑based Promotions in jurisdictions where required by law, no purchase is necessary to enter or win and purchasing does not increase chances of winning. Odds depend on number of eligible entries received. Alternative methods of entry, if any, will be stated in the Official Rules.

Prizes. Prizes may include Virtual Items or physical goods. Winners are responsible for any taxes or fees associated with acceptance of a prize. We may substitute prizes of equal or greater value if a prize becomes unavailable.

Skill‑Based Tournaments. Tournaments (including ladders or brackets) will be skill‑based competitions determined by gameplay performance. Entry fees, if any, will be Virtual Items only (no real‑money wagering). Tournaments are not gambling and are unavailable where restricted by law. Cheating, collusion, smurfing, or using unauthorized tools is prohibited and may lead to disqualification or account action.

Administration. We may record, stream, broadcast, photograph, or otherwise capture gameplay and tournament participation. By entering, you grant us a license to use your username, likeness, and gameplay for administering and promoting the Promotion, as permitted by law.

Changes & Cancellation. We may modify, suspend, or cancel any Promotion for reasons including fraud, technical failures, or any other factor that impairs integrity or proper functioning. Our decisions regarding eligibility, results, and awards are final and binding.
